Investor eligibility, KYC, AML, sanctions screening, disclosures, and market-specific terms apply before any transaction can proceed.

1. Introduction
'Mystocks', 'Mystocks Inc', 'mystocks.africa', 'mystocks.market', 'mystocks.markets', 'mystocks.co.za' or 'we' refers to one or more of the companies in the Mystocks group that operate in South Africa and across regional African nodes.
'You', 'your' or 'yourself' refers to the user of the Mystocks website ('site'), and as the context requires, may be a reference to any client or potential client of Mystocks, or any financial adviser, representative, juristic representative and or introducing broker, who act on behalf of such client.
These Terms & Conditions ('Terms') become effective when you access this site for the first time and constitute a valid and binding agreement between Mystocks and yourself. The current version of these Terms governs our respective rights and obligations each time you access this site. If you do not agree to these Terms, please do not make use of this site.
By using the Services, you are confirming your consent to be bound by the terms of this Agreement. If you do not agree, Mystocks is not willing to provide you with access to the Services and you should immediately discontinue your use of the Services.
2. Definitions

“JSE”

“Platform Providers”
Regulated third-party brokers and custodians with whom Mystocks maintains API bridges.
“Web Based Product”
Any financial instrument, SaaS node, or yield account offered via the Platform.
“Website”
The domains mystocks.africa, mystocks.markets, or any other Mystocks-owned node.
“User”
The person contracting with Mystocks for investment access.
3. Use at Own Risk & Disclaimers
Mystocks and/or its Securities and platform providers shall not be responsible and disclaims any liability for any loss, liability, damage (whether direct or consequential) or expense of any nature whatsoever which may be suffered by the User or any third party as a result of or which may be attributable, directly or indirectly, to the use of or reliance on any information or service provided through the Website.
NO FINANCIAL ADVICE
No research, opinions, information or content contained in the Website shall be construed as advice and is offered for information purposes only. The information contained in any communication, including web pages, emails and attachments, is not to be construed as advice in terms of the Financial Advisory and Intermediary Services Act 37 of 2002.
It is recorded that certain of the Web Based Products pertain to securities trading services executed via the Website through a Member Associate. In this respect Mystocks will use reasonable endeavours to transfer all share trade instructions received through the Website to its securities and platform providers, in a prompt and timely manner. However, neither Mystocks nor its Securities and platform providers shall be responsible, and disclaims all liability for, any claims arising from the late or delayed attendance by Mystocks or its partners to the user's instructions.
4. Applications & Access
Mystocks grants you a personal, non-exclusive, non-transferable, limited and revocable license to use our platform and applications. This license is strictly for your personal, non-commercial use, and is subject to your continuous compliance with these Terms.
We reserve the right to upgrade, modify, or maintain our digital infrastructure at any time. While we strive for 99.9% uptime, we do not guarantee uninterrupted access and will not be liable for losses incurred during maintenance windows or technical failures.
5. Credit Enquiries
By registering an account, you expressly authorize Mystocks or its authorized agents to conduct credit enquiries and verify your financial standing with registered credit bureaus and financial institutions.
This information is used to determine your eligibility for specific premium products, margin facilities, or institutional access tiers. All such enquiries are performed in accordance with the National Credit Act and POPIA.
6. Copyright & Logos
All content, trademarks, data, software, icons, and logos on this site are the property of Mystocks Inc or its licensors and are protected by South African and international intellectual property laws.
Any unauthorized use, reproduction, or distribution of Mystocks' intellectual property is strictly prohibited and will be met with legal action. Users are prohibited from using "scraping" technology or any automated systems to extract market data or user information from the platform.
7. Feature Discontinuation
Mystocks reserves the right to terminate, suspend, or discontinue any feature, product, or investment node at its sole discretion, with or without notice.
In the event of a significant product sunset, Mystocks will provide reasonable assistance to ensure Users can migrate their data or settle outstanding trade positions through our partner liquidity nodes.
8. Usernames & Status
You are responsible for maintaining the confidentiality of your account credentials. All activities performed under your username are deemed to have been executed by you.
Mystocks utilizes tiered status levels (Standard, Institutional, Private). Changes in your account status are subject to verified financial credentials and continuous adherence to our trading conduct standards.
9. Digital Delivery
By using the platform, you agree to receive all communications, including trade confirmations, tax certificates, and legal notices, via digital delivery (Email or Platform Notification).
Digital communications shall be considered as received by you at the time they are dispatched from our servers, regardless of your actual login status. You are required to maintain a valid and updated email address on record.
10. Subscription Terms
Access to certain market nodes and premium research requires a recurring subscription. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable once the billing period has commenced.
Mystocks reserves the right to adjust subscription pricing with 30 days notice. Continued use of the service after a price adjustment constitutes acceptance of the new terms.
11. Delivery Times
Trade settlements typically follow regional market standards (e.g., T+3 for JSE Equities). Digital products and subscription access are delivered instantly upon successful payment verification.
Mystocks is not responsible for delays caused by third-party banking systems or upstream liquidity provider latency.
12. Refund Policy
Due to the digital and real-time nature of market data and institutional research, all sales are final. We do not offer refunds for subscription fees or data access once the service has been provisioned.
Discretionary credits may be issued in exceptional cases of verified technical error on our part, evaluated on a case-by-case basis.
13. JSE Disclaimer
JSE market data is provided for informational purposes only. The JSE and Mystocks make no warranties, express or implied, regarding the accuracy or completeness of the data. Use of JSE data is subject to the JSE's own Data Terms of Use.
You may not redistribute, re-sell, or publish JSE data obtained through our platform to any third party without express written consent from both Mystocks and the JSE Limited.
14. General Provisions
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the South African courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Breach of Terms
In the event of a breach of these Terms, Mystocks reserves the right to immediately suspend or terminate your account without notice, in addition to pursuing any other legal remedies available under South African law.
Users will be held liable for any damages, including legal costs on an attorney-and-client scale, incurred by Mystocks as a result of such breach.
17. Estimates Disclaimer
Any financial estimates, projections, or consensus price targets provided on the platform are forward-looking statements and are subject to significant risks and uncertainties.
Past performance is not indicative of future results. Mystocks does not guarantee the accuracy of any third-party analyst estimates provided through our aggregation nodes.
18. Group Privacy Policy
Your privacy is of paramount importance. Mystocks processes personal data in strict accordance with the Protection of Personal Information Act (POPIA) and, where applicable, international standards such as GDPR.
We utilize enterprise-grade data encryption and strict access controls. By using the platform, you consent to the cross-border transfer of data to our regional market nodes and secure cloud providers as necessary to execute the Services.
19. PAIA Manual
The Promotion of Access to Information Act (PAIA) gives you the right to access information held by private bodies. Our PAIA Manual, which outlines the procedure for requesting such information, is available upon request from our compliance office.
20. Security Protocol
Mystocks implements multi-factor authentication (MFA), end-to-end encryption for sensitive data, and continuous security monitoring.
You are strictly prohibited from attempting to bypass any security features, conduct unauthorized penetration testing, or reverse-engineer any part of the Mystocks infrastructure. Any such attempt constitutes a criminal offense under the Cybercrimes Act.
21. FAIS & Licensing
Mystocks Inc and mystocks.africa operate as a financial technology platform. mystocks.africa is not a broker-dealer and does not provide broker-dealer services in any jurisdiction where it has not obtained the required permissions.
Mystocks Technologies (Pty) Ltd is the South African operating company and is positioned under a juristic representative framework. Current public disclosures reference TanFox (Pty) Ltd, an Authorised Financial Services Provider, FSP 52040.
Brokerage, custody, settlement, financial advice, and regulated dealing activities are performed by regulated stockbrokers, investment banks, broker-dealers, custodians, or appointed partners in each applicable market. Specific partner and FSP details are disclosed at the point of trade execution and within the relevant account or institutional dashboard where applicable.
The licensing roadmap for Kenya, Nigeria, the United States, and the United Kingdom is forward-looking and subject to regulator review, approval, partner onboarding, and market-specific conditions.
22. FICA / KYC Guide
To comply with Anti-Money Laundering (AML) and Financial Intelligence Centre Act (FICA) regulations, we require all Users to undergo identity verification.
This includes providing proof of identity, proof of residence, and in certain institutional cases, proof of source of funds. Failure to provide requested FICA documentation will result in account restriction or closure.
23. Conflict of Interest
Mystocks maintains a robust Conflict of Interest policy. We disclose any material interests or affiliations that may potentially impact the objectivity of the information provided on our platform.
24. Order Execution
Orders placed through the Website are routed to our partner brokers for execution. We strive for "best execution," but we cannot guarantee specific fill prices or execution speeds given the nature of global financial markets.
25. Market Conduct
All users are required to adhere to strict Market Conduct rules. Prohibited activities include insider trading, market manipulation, front-running, and any other activity that compromises the integrity of the financial markets.
Mystocks actively monitors platform activity and will report suspicious behavior to the relevant regulatory authorities, including the FSCA and JSE Surveillance.
